How Ghana’s Cyberbullying & Defamation Laws Apply in the Webkid Case

1. Cyberbullying under the Cyber Security Act, 2020 (Act 1038)
Ghana’s _Cyber Security Act_ makes it an offense to use electronic communication to harass, threaten, or cause distress to another person. If a post is deemed to intentionally harm someone’s reputation or emotional well-being, the police can investigate it as cyberbullying.
Penalties can include fines and/or imprisonment, depending on the severity. This is likely the basis for Webkid’s detention at Osu Police Station while investigations continue.
2. Criminal Defamation under the Criminal Offences Act, 1960 (Act 29)
Ghana still has criminal defamation on the books. Section 112-113 of Act 29 makes it an offense to publish false statements that injure a person’s reputation.
